Terms and Conditions
Official commercial guidelines governing industrial equipment purchases, manufacturer warranty, PMEGP subsidy documentation, logistics dispatch, and onsite commissioning.
Acceptance of Terms & Scope
These Commercial Terms and Conditions ("Terms") constitute a legally binding agreement between Divyanshi Industries ("Manufacturer," "we," "us," or "our") and any individual, proprietary firm, partnership, Farmer Producer Organization (FPO), or corporate entity ("Buyer," "Customer," or "Client") placing an inquiry or purchasing machinery.
By placing an order, requesting a formal quotation, applying for PMEGP project reports, or accepting delivery of machinery manufactured at our Hajipur facilities, the Buyer acknowledges that they have read, understood, and agreed to be bound by these Terms in full.
Quotations, Pricing & Proforma Invoices
- Quotation Validity: Official stamped manufacturer price quotations and Proforma Invoices issued by Divyanshi Industries remain valid for 30 calendar days from the date of issue. After 30 days, prices are subject to revision based on raw material commodity indexes (structural steel IS 2062, cast iron, and pure electrolytic copper).
- Taxes & Statutory Levies: All machinery quotations are subject to applicable Goods and Services Tax (GST) as mandated by the Government of India under GSTIN 10ERYPS5664B1ZF. Applicable tax invoices will be issued upon commercial dispatch.
- Payment Terms: Standard orders require a 25% to 30% advance booking deposit to schedule fabrication, with the remaining balance payable prior to vehicle loading and dispatch from our Hajipur facility. Transparent bank transfers (RTGS / NEFT) are standard.
PMEGP & Government Loan Schemes
Divyanshi Industries provides comprehensive technical documentation support for entrepreneurs seeking capital subsidies under the Prime Minister's Employment Generation Programme (PMEGP), PMFME, and Mudra schemes:
Manufacturer Role: We provide stamped machinery price quotations, Bill of Quantities (BOQ), certified plant floor blueprints, and bankable 5-year Detailed Project Reports (DPR).
Independent Sanction: The Buyer understands that loan sanction and subsidy disbursement (ranging from 15% to 35%) are administered independently by nationalized banks, District Industries Centres (DIC), and KVIC. While our documentation is fully compliant with bank guidelines, approval is contingent upon the applicant's credit score and banking norms.
1-Year Comprehensive Manufacturer Warranty
Every commercial machine manufactured by Divyanshi Industries carries a 1-Year Manufacturer Warranty from the date of dispatch covering structural metallurgy, frame welds, gearboxes, and electric motors against manufacturing defects:
- Casting fracture due to metallurgical defect
- Electric motor coil burn under normal rated load
- Gearbox gear teeth shear or internal bearing failure
- Structural frame weld cracks under rated RPM
- Routine wear items (emery stone dressing, pulverizer beaters, V-belts)
- Damage caused by foreign metal objects (nails/stones) fed into chambers
- Motor burn resulting from extreme phase voltage fluctuation or lack of starter relays
- Unauthorized modifications made to machine geometry
Pre-Dispatch Trials & Factory Inspection
In line with our quality transparency policy, the Buyer is entitled and actively encouraged to visit our Hajipur manufacturing bays (Hilalpur or Rahimapur) to witness a 4-hour live material trial on their machine prior to dispatch.
Clients may bring their own grain, mustard seeds, or spices to inspect extraction yield, operating temperatures, and decibel levels. Once the machine passes pre-dispatch inspection and the trial sign-off is completed, the machine is packed and prepped for vehicle transport.
Freight Dispatch & Transit Terms
- Delivery Mode: Machinery is dispatched through verified commercial transport logistics carriers directly to the Buyer's nearest transport godown or doorstep address across Bihar, Jharkhand, UP, West Bengal, and pan-India.
- Freight Charges: Unless explicitly stated as "Freight-Paid" in the proforma invoice, transport freight and vehicle transit insurance are payable by the Buyer upon delivery (To-Pay basis).
- Unloading & Foundation: Unloading of heavy machinery from the transport truck and mechanical positioning onto the customer's factory foundation is the responsibility of the Buyer.
Onsite Commissioning & Operator Training
For commercial installations (oil mills, flour mills, automatic packaging lines), Divyanshi Industries provides experienced service engineers to supervise on-site erection:
- Technicians ensure proper foundation bolting, V-belt alignment, electrical phase balancing, and test batch production.
- Hands-on operational training is provided to the Buyer's mill operators, covering daily lubrication, stone clearance adjustment, and emergency safety stop protocols.
- Fooding and local lodging for the visiting engineer during the setup period are provided by the Buyer as standard industry practice.
Spare Parts & Lifetime Availability
Because Divyanshi Industries is a direct indigenous manufacturer (not an intermediary reseller), we guarantee lifetime spare parts availability for all machine models produced at our plants.
Genuine replacement worm screws, alloy shafts, pulverizer beaters, perforated screens, emery stones, and motor pulleys are stocked continuously at our Hajipur warehouse and can be dispatched within 24 to 48 hours to minimize any mill downtime.
Cancellation & Refund Policy
Due to the specialized engineering and custom motor specifications involved in commercial machinery fabrication:
- Orders canceled after fabrication has commenced are subject to a cancellation fee equivalent to actual material and labor expenses incurred up to the date of cancellation.
- Custom-engineered turnkey plants fabricated to non-standard dimensional requirements cannot be returned once dispatched in satisfactory working order.
- Any payment adjustments or refunds will be executed via transparent banking channels within 14 business days following mutual written reconciliation.
Legal Jurisdiction & Governance
These Terms and Conditions shall be governed by, interpreted, and construed exclusively in accordance with the substantive laws of the Republic of India.
In the event of any commercial claim, dispute, or difference arising out of or in connection with machinery supply, performance guarantees, or billing, both parties agree to first seek an amicable mutual resolution. If unresolved, the dispute shall be subject to the exclusive jurisdiction of the competent civil courts situated in Hajipur, Vaishali District, Bihar, India.
